Businessman Jimnah Mbaru has been sued over child support.
A 24-year-old claims that she met Mbaru in 2017 where he impregnated her and abdicated his responsibilities.
Mbaru is being sued together with an advocate with whom he allegedly entered into a power of attorney to take care of his parental responsibility.
The mother claims that Mbaru has neglected his parental responsibility for the child and instead donated his responsibility to Kaburu through a power of attorney, therefore, treating the child as a property of chattel goods.
The mother of the 4-year-old wants the court to order Mbaru to pay her Sh320,000 monthly upkeep and a further Sh600,000 school fees per year at an international school which amounts to Sh 4.4 million.
According to the court records, the mother also wants the court to bar the advocate from holding himself out as a putative father.
“Mbaru gave a power of attorney to Erick Kaburu to act as a punitive father to the minor as if the minor is a property of chattel, a concept that is not known to the Constitution of Kenya or the Children’s Act,”
“Mbaru is a senior citizen, a prominent businessman who owns businesses worth billions of shillings including banking and control of Nairobi Security Exchange and therefore capable of supporting the child without any difficulties,” further read the court documents
The breakdown of the claimed expenses is as follows: Food- Sh50,000, Medical – Sh50,000, Clothes – Sh50,000, Shopping – Sh100,000, House Help- Sh50,000 and miscellaneous- Sh20,000.
