The High Court has reversed the acquittal of former Finance Minister Amos Kimunya’s Sh60 million fraud case.
In June 2021, Magistrate Felix Kombo acquitted the former Finance minister.
Among those acquitted with Kimunya were former director of land adjudication Lilian Njenga and Junghae Wainaina.
The director of public prosecutions through Alexander Muteti said the court had made a mistake by setting the three, Kimunya and two of his co-accused, free.
On Thursday October 6, Justice Esther Maina agreed with the DPPs case that was established against the three, stating that Kimunya, Lilian Njenga and Junghae Wainaina should not have been acquitted, instead should have been put to trial.
The judge further clarified that the three were allowed to appeal in their case.
“Appeal is allowed. They will go back to the trial court to enter their defence. Count is, however, defective,” said the Judge.
The three are set to defend themselves on five counts of corruption related offences after presenting themselves before Chief Magistrate Lawrence Mugambi on October 11 for directions.
If they fail to, the Judge said warrants of arrest will be issued against them.
Amos Kimunya is the majority leader of the National Assembly of Kenya under the Jubilee Party and former Member of Parliament for Kipipiri Constituency.
