A report filed by the Chief Registrar of the Judiciary Anne Amadi reveals that Independent electoral and Boundaries Commission (IEBC) used form 34A book of 2, the second set of ballot papers that it had previously said it would not use following a resolution with the political parties, in August’s general elections.
The contentious set of ballot papers were used in some 15 polling stations in Kericho, Kiambu, Kakamega, Nyandarua, Mombasa, Nandi and Bomet.
Some of the presiding officers where form 34A book of 2 were used, the report reveals, claim they were ignorant of the relevant guidelines issued by IEBC leadership on which set of forms were to be used for the purpses of recording presidential results.

Others said that they used form 34A book of 2 on account that form 34 A book of 1 was spoilt but were unable to avail the said spoilt version for purposes of scrutiny.
The report also reveals that the voter identification kit had an application that could be used to convert the images of form 34A from JPEG to PDF formats.
However, it remains unclear the criteria that was used to select the images that were converted from JPEG to PDF formats and whether that was a requirement by the IEBC.
The judges will interrogate the content of the report at length today before retreating to write their verdict over the weekend.
