Ex-Attorney General and Senior Counsel Githu Muigai has stated that the 2022 presidential election was the fairest and all observers came back with one conclusion that it was a transparent election.
“Was it a perfect election no! There is nothing like a perfect election. These were human beings who can have a few errors,” he said.
Speaking when he submitted his response to the presidential petition on Thursday at the Supreme Court, the former AG said there were a few errors but does not warrant the nullification of the results.
“Were the few errors of a magnitude to allow this court set aside the election? Our answer is no,” he said.
SC Muigai said the submissions by the petitioners are generalities that need not be admitted.

“This is one of the few petitions that this court has seen that is full of generalities and innuendos and hypothetical statements. No evidence and nothing of value,” he said.
“They have been framed in general speculative terms, lacking clear evidence. This petition lacks merit.”
Muigai said the petitioners have made grave accusations and even implied treason.
“All that without a shred of evidence, especially as it relates to Chebukati. His attack was personalised, vindictive and intended to lower his standing in our community and within the legal profession and it was unwarranted,” he said.

“I have had occasion to defend Chebukati in 2017, this gentleman was being vilified for doing what the court told him to do.”
He said the attack on Chebukati has a long history. “There is nothing wrong with IEBC or Chebukati.”
