Wiper party has replaced former Nairobi governor Mike Sonko with Kisauni MP Ali Mbogo as its candidate for the Mombasa gubernatorial race.
The Independent Electoral and Boundaries Commission (IEBC) on Monday told the court that Wiper had submitted the name on July 1.
A three-judge bench hearing the petition was told that Sonko is listed as Mbogo’s running mate.
IEBC Lawyer Edwin Mukele, told justices Stephen Githinji, Olga Sewe and Anne Onginjo that Sonko was fighting a lost battle.
Initially Mbogo had been picked as Sonko’s running mate
The IEBC Dispute Resolution Committee allowed Wiper to submit a replacement of its Mombasa candidate by July 1.
This followed the rejection of a petition by Sonko following his disqualification by IEBC .
IEBC locked Sonko out of the race after he failed to present a certified coy of his degree certificate
He has moved to court to block Wiper from presenting another candidate to IEBC.
On Monday, the court issued interim orders stopping IEBC from printing ballot papers for the Mombasa gubernatorial race.
The court also stopped IEBC from gazetting the names of candidates cleared for the Mombasa gubernatorial race.
The court is expected to issue its ruling tomorrow(Wednesday).
