The Director of Public Prosecutions has withdrawn the case filed against former Football Kenya Federation (FKF) President Nick Mwendwa according to Section 87 of the Penal Code.
Mwendwa was first arrested on November 14, 2021 on charges of fraud. He was then relreased the re-arrested again for the same charges.
However, through his lawyers Erick Mutua and Charles Njenga, Mwendwa, the former FKF president has been fighting to clear his name in court.
Moreover, after his arrest last year, the former FKF president was fired from office by Sports Cabinet Secretary Amina Mohamed who then appointed a Caretaker Committee to run the federation’s affairs.

Furthermore, the DPP applied for adjournment of the case on Tuesday, July 5 arguing that they had no witnesses. Moreover, they planned to review the evidence but their application was denied by the court, which ordered them to come ready to proceed with the case on Wednesday, July 6.
The renewed application made on Wednesday to adjourn on grounds that they did not have witnesses was again declined. Thence, forcing them to withdraw the case under section 87(a) of the penal code.
