Mombasa ODM gubernatorial candidate Abdulswamad Nassir has said that he is moving to court to challenge the move by IEBC to postpone polls in the county.
Nassir is heading to court to compel IEBC to conduct the governor elections on Tuesday as earlier announced.
On Wednesday IEBC chair Wafula Chebukati postponed the elections for Mombasa and Kakamega indefinitely citing frustrations and intimidation of his officials.
The elections which were to take place on August 9, were postponed to August 23 on technical issues before being called off indefinitely
Chebukati said the commission will announce a new date for the elections.
Also affected were four constituencies whose parliamentary elections were postponed
“The law is very clear about postponing the election, you cannot just wake up and decide to postpone it, haiwezekani” Nassir said.
“We will go to court, we are going to expect an order that the elections will be held on the stipulated date”
Nassir argues that the reasons given by IEBC cannot warrant the postponement of the election.
“We demand the election be done on Tuesday. We are also demanding answers as to why they were postponed,” Nassir said.
His ODM counterpart in Kakamega Fernandes Barasa also castigated IEBC for calling off the polls for a second time.
He also threatened to move to court to challenge the move by Chebukati.
