The state has handed back Deputy President Rigathi Gachagua Ksh.202 million that was frozen last year.
This was after the Asset Recovery Agency (ARA) reported that after gathering new evidence, they found out that the money forfeited to the state six months ago was not proceeds of crime.
They further stated that the DP Gachagua has explained the source and legitimacy of the said money to satisfaction.
According to ARA, the new evidence had not been presented to the judge as it was not in their possession at the time the high court was issuing its judgement.
As such, the Court of Appeal on Wednesday, February 1 vacated the forfeiture order issued by the High Court last year and also set aside the said judgment of the High Court.

Likewise, the judgement means that money held in three accounts at Rafiki Microfinance Bank in the name of Rigathi Gachagua will be released to him. Furthermore, the funds held in another account belonging to Jenne Enterprises will also be released.
