A petition filed on August 8, 2022, challenging the suitability of Rigathi Gachagua as Kenya’s Deputy President revoked by The Supreme Court.
The seven-judge bench ruled out the reasons filed by the petitioners; said they were incompetent.
Jackson Mwalulu, Beatrice Kamau, Amos Wafula, Kenneth Njagi, Meshack Churchill,Sophie Dola, Julia Wanjiku, James Maina, Simon Lokoma, Carolyne Ayitso, and Johnson Mwakaba were the petitioners in the case against Rigathi.
The 11 filed the petition on the basis that Rigathi lacked the integrity required to serve in a top Government office, which does not comply with Chapter 6 of the Constitution.

“The Petition herein seeks to safeguard and enforce the principles, values and objectives of the constitution including chapter six thereof and its application to the eligibility of candidates for President and Deputy President,” read the petition.
Further, the petitioners had requested the court to Invalidate William Ruto’s choice, after picking Gachagua as his running mate, claiming it was in violation of the constitution.
“Unless the court hears and determines the constitutionality of the registration and gazettement of the 1st and 2nd Respondents as candidates, it amounts to aiding and abetting illegalities if they are sworn into their respective offices in the event they get elected,” further read the petition.
The apex court, however, requested the 11 struck out in the basis that they were in abuse of court and their reasons were incompetent.
