Former Nairobi governor Mike Sonko suffered a blow after the High court rejected video evidence he presented.
The three judge bench refused to admit the video of Sonko presenting nomination papers for the Mombasa Governor seat.
The Judges said the video was not admissible.
Judges Olga Sewe, Anne Onginjo and Stephen Githinji said contents of the video whose could not be verified.
“Having heard the submissions from both parties, we dismiss the application as sought by the petitioner to have the video played in court because it’s not admissible and its source cannot be verified,” said judge Sewe.
IEBC lawyer Edwin Mukele objected the move saying the video was not annexed as evidence in the petition.
“We object to the production of the video, despite the urgency of the matter, since there is a danger in agreeing for the production of the video,”said Mukele
“The danger being that every other aspirant will use this as an avenue to produce their own videos,” he added.
Earlier the judges had issued conservatory orders, barring IEBC from printing ballot papers for candidates of the Mombasa governor race.
The orders still stand until the case is heard and determination.
