The Deputy President elect Rigathi Gachagua’s corruption case which was scheduled to kick off today has been postponed following the Supreme Court’s verdict announcement of the presidential results petition expected at 12.00 noon, Monday 5th 2022.
Many cases among them Gachagua’s, were affected after the Judiciary closed the Milimani Law Courts to allow the seven judge bench conduct the petition hearing by the Azimio la Umoja party leader Raila Odinga and his running mate Martha Karua.
The 2010 constitution provides immunity for the President or people performing presidential office functions during tenure in office against criminal court proceedings.
The question remains, does that extend to the deputy president in the case that the petition by the Azimio la Umoja One Party Coalition is dismissed?
Rigathi Gachagua however is in a tight position as he might be the first deputy president to undergo criminal court proceedings while in office, if the verdict is in their favor.

The former MP was set to appear before the Anti-Corruption Magistrate, Victor Wakumile on allegations of having acquired a lump sum of 7.4 Billion Kenyan Shillings through Government dealings between 2013 and 2020 alongside 9 others.
The allegations stated that the above mentioned were in a conspiracy that defraud the Nyeri County Government of 27.4 Million Kenyan Shillings allegedly for supply to the Nyeri Provincial Hospital with dialysis machines.
Rigathi denied the accusations, despite the 14 witnesses lined up to testify against him at the Milimani Law Courts during the yet to happen hearing.
