The High Court has ordered embattled National Parents Association (NPA) chairman Nicholas Maiyo to vacate office within seven days.
High Court Judge Hedwig Ong’undi allowed an application by the newly elected officials of the association to revoke a notice that had gazetted national representatives, led by Maiyo as the legitimate new officials of the association.
The court ordered the Maiyo-led team to vacate office with immediate effect as they are illegally in office.
Consequently,the court approved the new faction of representatives led by David Obuhatsa Silas and Eskimos Kobia who were gazetted on September 9, 2022, as the new chairperson and Secretary General of the Parents National Association respectively to take over the office.
“An order is hereby issued Maiyo, Sarah Kagendo, Jeremiah Nyakundi, Onesmus Kauwi, Patrick Lumumba, Rose Otiek and Mohammed Omar whether by themselves, their proxies, agents or servants from denying the Obuhatsa-led faction from accessing the offices of the National Parents Association, ” ordered Justice Ong’undi.
The Maiyo faction was further ordered to hand over all documents including bank accounts, website, sponsorship agreements and receipt books of the association which are in their custody within seven days.
The court further restrained Maiyo from addressing any Media briefs on behalf of the parents association or participating in any meeting organized by the Ministry of Education or any education stakeholder.
The new faction had informed the court that Maiyo was not properly elected as the chairman of the association and has been holding office illegally.
In May 31, 2022, a court nullified the elections of the Maiyo-led team and ordered the association to conduct fresh elections within 45 days from the date of the court’s decision.
It is said that the election was conducted as directed by the court and the new officials of the Obuhatsa-led faction were gazetted under Gazette notice number 10685 on September 9, 2022.
However,the Maiyo-led team refused to hand over the association offices situated at Reinsurance plaza 13th floor leading to the current suit.
