Former Nairobi governor Mike Sonko has gotten a reprieve after a three-judge bench sitting in Mombasa issued interim orders stopping Independent Electoral and Boundaries Commission (IEBC) from printing ballot papers for candidates in Mombasa gubernatorial race.
At the same time the bench consisting of Justices Olga Sewe, Ann Ong’injo’ and S. Githinji also issued conservatory orders stopping the IEBC from gazetting the names of the six Mombasa governor seat candidates pending the hearing and determination of Mike Sonko‘s application.
Sonko is seeking to overturn IEBC’s Dispute Resolution Committee’s decision to bar him from vying for the seat.
Consequently the court has also barred Wiper Party from nominating another candidate pending the hearing of the petition.
Last week, Chief Justice Martha Koome appointed the bench to hear and determine the matter.
“My instructions are to inform you that the honourable Chief Justice has received the original court file from the High Court in Mombasa further the CJ has empanelled a 3-judge bench to hear and determine the matter in Mombasa,” the notice read in part.
In the petition Sonko wants to block Wiper party from presenting another candidate following his disqualification
He also wants IEBC to be compelled to clear him for the race
