The court dispute surrounding the burial of former Kenya Commercial Bank (KCB) executive Rosemary Koech Kimwatu has come to an end after her husband, Kelvin Migwe Kimwatu, withdrew the cases he had filed over her burial.
Kimwatu told the Milimani Law Courts on August 31 that he would no longer pursue the matter after confirming that his wife had already been buried.
He also declined to seek the exhumation of her remains or pursue contempt of court proceedings against her relatives or KCB.
Through his lawyer, Ramadhan Abubakar, Kimwatu told the court he had been denied the opportunity to mourn his wife properly but chose not to prolong the dispute through further legal action.
” Leave to God whatever happened on the night of his wife’s burial,” Kelvin Migwe Kimwatu stated before the court.
Rosemary Koech Burial Dispute
The legal dispute began after Kimwatu moved to court seeking to be involved in his wife’s funeral and burial arrangements.
In his argument, Kimwatu claimed that he had been excluded from decisions concerning her funeral and wanted her buried at his ancestral home in Matasia, Kajiado County.
On August 28, a Milimani court issued interim orders restraining Rosemary’s family, KCB employees, and other parties from removing her remains from Lee Funeral Home.
In addition, the court order barred the family from proceeding with her burial without Kimwatu’s involvement. Despite the order, Rosemary was buried at her parents’ home in Kericho on the night of August 28.

The burial subsequently became the subject of court proceedings on August 31, with Kimwatu having the option to seek further legal action for the alleged breach of the court order.
Kimwatu, however, chose not to pursue either option. Lawyers representing Rosemary’s parents said they had no objection to the withdrawal of the case.
The family also agreed that Kimwatu and his four children would be allowed to access Rosemary’s graveside.
Further, the family’s lawyers, Felix Kiton and Phillip Langat, noted that they had no intention of permanently preventing Kimwatu from visiting the grave and described him as their son-in-law.
“We hope that the bonds that tied them together for over 20 years will be mended,” the lawyer told the court.
Following the parties’ agreement, the court withdrew the suit without an order as to costs.
