UDA Governor Faces Impeachment Again

In less than a year since the Senate thwarted an impeachment attempt, a fresh motion has been tabled in the Kericho County Assembly against Governor Erick Mutai.

Kericho Members of the County Assembly (MCAs) have tabled a notice of second impeachment motion against Governor Mutai over alleged gross violations of the Constitution, abuse of office, and gross misconduct.

The motion is also based on grounds of gross violation of various national and county laws and serious reasons to believe that the Governor has committed crimes under national and county laws.

In an official statement addressed to the County Clerk and dated August 6, Sigowet Ward MCA Kiprotich Rogony notified the clerk of his intention to table a motion for the governor’s impeachment.

“Kindly find attached the following documents for your action: Proposed motion for the removal by impeachment of Dr. Erick Mutai, Kericho County Governor, Evidence in support of the said proposed motion; and Signed list of Members in support of the proposed Motion,” read the letter in part.

Kericho MCAs Table New Impeachment Motion Against Governor Erick Mutai

Sigowet Ward MCA Kiprotich Rogony, the mover of the motion, has outlined the evidence backing his fresh impeachment motion against Governor Erick Mutai, tabled at the Kericho County Assembly.

In his official communication, Rogony indicated that the motion is supported by multiple documents and testimonies, including:

  1. An affidavit in support of the motion, duly sworn in on August 5, 2025
  2. Exhibits annexed to the affidavit in support of the motion
  3. Witness statements and additional affidavits to be presented during the hearing of the motion

“Honorable Speaker, I beg, with the support of the Members of the County Assembly of Kericho—whose names and signatures I have herewith—to give notice of a motion for the impeachment of His Excellency Honorable Eric Kikwete Mutai, the Governor of Kericho County,” he said.

“Further, the affidavit presented herewith verifies the accuracy and reliability of the exhibits attached to the motion.”

In his submission, MCA Rogony invoked key constitutional and legal provisions to justify the impeachment motion, stating:

  1. “Article 2 of the Constitution of Kenya, 2010 affirms the supremacy of the Constitution as the supreme law of the Republic, binding all persons and State organs at both levels of government.”
  2. “Article 10 of the Constitution, Section 3 and Section 16 of the Leadership and Integrity Act, 2012, and Sections 9, 10, and 12 of the Public Officer Ethics Act, 2003 establish, among others, the principle of the rule of law.”

How the Governor Survived the 2024 Impeachment in the Senate

Governor Erick Mutai survived impeachment after 34 Senators voted in support of a preliminary objection raised by his defence team.

Leading the governor’s legal team, lawyer Katwa Kigen argued before the Senate that the two-thirds threshold—equivalent to 31.3 members—had not been met when the Kericho County Assembly voted to impeach the governor.

He pointed out that only 31 out of the 47 Members of County Assembly (MCAs) had supported the motion, falling short of the required 32.

The Senate subsequently engaged in a debate over the technical argument before voting, with 10 Senators opposing the preliminary objection.

The allegations included misappropriation, misallocation, and illegal withdrawal of county revenue and public funds, as well as abetting the mismanagement of resources raised from the public.

He also faced accusations of abuse of office through illegal appointments, unlawful dismissals and transfers, and the usurpation of constitutional and statutory functions of the County Public Service Board.

Additional charges involved undermining, discrediting, and impeding the oversight role of the County Assembly.

Most notably, Mutai was accused of engaging in indecent and unnatural sexual conduct, including forcing female staff into non-consensual anal sex, dangerous and unprotected sex, and persistently intimidating, molesting, and harassing county officers who refused to conform to his directives.

The MCAs claimed these actions created an atmosphere of fear, uncertainty, and despondency within the county government.

Governor Mutai had denied all the charges brought against him by the MCAs.
