The Ethics and Anti-Corruption Commission (EACC) has issued a directive requiring all public officers to declare their wealth.
In a notice dated November 11, 2025, the Commission reminded state and public officers to submit their declarations as required under the newly ratified Conflict of Interest Act, 2025.
The directive follows the coming into force of the Conflict of Interest Act, 2025, which took effect on August 19, 2025.
EACC announced that the declaration period for 2025 runs from November 1 to December 31, 2025. The process applies to all state and public officers, who must file their declarations through their respective Responsible Commissions, as outlined in Section 32 of the Act.
“It is hereby notified for general information that, pursuant to the Conflict of Interest Act, 2025 [the Act”) which came into operation on August 19, 2025, the two-year declaration of income, assets, and liabilities for the year 2025 will be filed between November 1, 2025, and December 31, 2025. All State and public officers are required to file their declarations to their respective Prescribed Responsible Commissions,” read the notice.
EACC Issues Directive to Public and State Officers
According to the notice signed by EACC Secretary and Chief Executive Officer, Abdi Mohamud, the Commission is mandated to administer and oversee the implementation of the new Act, which replaces the Public Officer Ethics Act.
“Development of the regulations and administrative procedures to guide the implementation of the Act is currently underway,” said Mr. Mohamud.
Meanwhile, the EACC has issued interim guidelines to ensure compliance with the two-year declaration cycle for 2025.

According to the Commission, all officers must declare their income, assets, and liabilities, as well as those of their spouses and dependent children under the age of 18.
They are also required to report any material changes affecting these declarations, as defined under Section 31(4) of the Act.
The Commission stressed that completing and submitting the declaration is a personal responsibility, and officers are personally accountable for the completeness, accuracy, and truthfulness of the information provided.
Roles of Responsible Commissions
EACC further outlined the specific responsibilities of the Responsible Commissions. The Responsible Commissions are required to undertake the following general responsibilities with respect to the declarations received from state and public officers for which they are prescribed-
- Analyze the declaration to ascertain its completeness and correctness, ascertain whether it raises possible issues of conflict of interest, and whether, on the face of the declaration, it contains any discrepancy or inconsistency;
- Within six months from 1st January 2026, seek any clarifications from the declarant on any information that may have been omitted, or to explain any discrepancies or inconsistencies in the declaration;
- Process requests for access to a declaration by any person or law enforcement agency.
- Maintain safe custody and storage of the declarations, and retain declaration information collected under the Act for at least five years after the declarant ceases to be a public officer.
- Take such appropriate disciplinary action against a state or public officer who fails to comply with any of the requirements for declaration of income, assets, and liabilities:
- Refer to EACC for forfeiture, any undeclared or unexplained assets, and
- Submit compliance reports to the EACC by July 31, 2026, in the prescribed template.
