The court has declared the merger between the Amani National Congress (ANC) and the United Democratic Alliance (UDA) unlawful and unconstitutional.
The ruling stated that the ANC remains a duly registered political party.
Additionally, the court also directed that all assets transferred to the UDA under the merger be returned to the ANC.
On January 17, 2025, Ruto’s party UDA and ANC merged to form the United Democratic Alliance Party.
UDA Chairperson Cecily Mbarire announced that Lamu Governor Issa Timamy, who was ANC’s party leader, will be one of the new outfit’s deputy party leaders.
“We are extremely happy as UDA that finally, we have come to the end of this process, which was delayed because of had bottlenecks and challenges,” Mbarire said.
“Further to the inclusion of former ANC officials in the leadership of the UDA Party, other staff members will also be incorporated into the secretariat of the party, while structures and organs of the ANC will be integrated into the UDA Party,” she said.
Court Nullifies ANC-UDA Merger, Orders Return of Assets
She revealed that when Deputy President Kithure Kindiki assumed office as UDA deputy party leader, his leadership helped resolve the party’s challenges.
Barire noted that the pre-merger coalition benefits and commitments within the Kenya Kwanza Coalition have been incorporated into the merged party and will support the objectives of the new entity.
She added that the parties have also agreed on the transition, implementation, and monitoring of all obligations outlined in the merger agreement.

In its leadership, Omboko Milemba, ANC’s secretary- general, became the new party’s deputy secretary-general.
The merger event was held at State House, Nairobi, and was witnessed by President William Ruto and Prime Cabinet Secretary Musalia Mudavadi.

Mudavadi on Why ANC Joined UDA
On January 19, Mudavadi said that the merger between the two political parties was to help Ruto unite the nation.
He called on all Kenyans to support him fully.
The merger followed Musalia’s entry into the Kenya Kwanza coalition, where he campaigned for Ruto’s 2022 presidency.
Mudavadi disclosed that the Kenya Kwanza coalition was strategically formed ahead of the 2022 General Election, with careful planning aimed at securing a first-round presidential victory.
He added that after deep reflection and guidance from religious leaders, he and Speaker of National Assembly Moses Wetangula decided to join forces with then Deputy President William Ruto, the UDA presidential candidate.
