Homa Bay County led by Governor Gladys Wanga has announced plans to enforce rent payment and construction of undeveloped plots within the county.
In the notice on March 19, Lands and Housing County Executive Committee Member Dr. Peter Ogola listed the names of the individuals who have failed to pay rent/rates despite several previous demand notices.

“The following persons have either defaulted to pay rates/rent due to the County Government of Homa Bay and/or failed to develop plots allocated to their allotment letter/leases,” reads part of the notice.
Ogola said the plot owners had 60 days to develop their plots and pay all the outstanding rents through the KCB Account No. 1140763555.

He cited provisions of sections 7 and 19 of the National Rating Act (Act No:15 of 2024) as read together with provision of section 104 (d) of the Public Finance management Act (Rev. 2022) and Articles 190 (1) and 202 (3) (4) of the Constitution of Kenya.
The County announced that it will auction property belonging to these plot owners if they fail to clear their arrears.

Additionally, Ogola said the county government will apply legal measures to regain ownership of the undeveloped plots if they fail to comply with the notice.
“Take notice that in default as aforesaid, the county government of Homa Bay will remain with no option except to invoke the provisions of section 19(3)(d) of the National Rating Act which provides for auction of the rateable property for recovery of rates due,” reads part of the notice.
“Further, the County Government of Homa Bay will invoke all the applicable laws and conditions of the allotment/lease to repossess the undeveloped plots from the under listed persons without further reference to them.”
Homa Bay Town Sub County List
As per the notice, there are 120 undeveloped plots in Homabay Town Sub County.
The breakdown is as follows: Homa Bay Town (44), Rodi Market (20), Adongo Market (5), Nyagidnha Market (5), Lieta Kabunde Market (6), Marindi Market (4),Allotttee (2), BCR-Homa Bay Town (13), Akele Benga Market (5) and Imbo Market (16).

At the same time, there are 258 undeveloped plots in Rangwe Sub-County.
These include 56 in Rangwe Town, 39 in Nyangweso Market, 13 in Omoya Market, 16 in Ngegu Market, a plot in Bondo Kachar Market and two allottee plot owners.
Others are in Magwar Market (5), Nyawita Market ( 9), Adingo Market (4),Randung Market (18), Oboke Market (10), Ohero Market ( 5), Ndiru Market (6), Awach Tende Market (3) and Obwanda Market (6).

Undeveloped Plots in Other Sub-Counties
There are more plots in Rabango Market, Sombro Market, Mbeka market, Rariw (Namba) market, Landa and Omoche market.
Homa Bay Country also listed 467 undeveloped plots in Rachuonyo South Sub-County, 81 in Rachuonyo East Sub-County and 50 in Rachuonyo North Sub-County.
In addition, the county noted that there are 183 undeveloped plots in Suba South Sub-County, 364 in Suba North and 278 in Dhiwa Sub-County.
