Wetang’ula Demands Ksh20 Million from Former MP

National Assembly Speaker Moses Wetang’ula has issued a raft demands to former Tongaren Member of Parliament David Eseli over alleged defamatory comments.

In the demand letter shared by Eseli on Saturday, Wetang’ula holds that on March 20, 2024, Eseli insulted him in a “scandalous and bewildering manner” while addressing a congregation.

Eseli is accused of claiming in the public forum that the Speaker had entered into an agreement with Bungoma Governor Kenneth Lusaka that involved road construction contracts.

The speaker, through his lawyer, mentioned that Eseli made his remarks in the Bukusu dialect and accused him of having a deal with Bungoma County Governor Kenneth Lusaka, suggesting that Lusaka was to buy the Speaker an airplane.

“I warned you. Lusaka is my in-law, but I warned you not to associate with that person, but you did not listen. Now look at these issues. When I left, I had done a book manifesto. I said that we had done an MOU with West Kenya Sugar to construct roads,” reads part of the demand letter.

“They went and revived the MOU, and it is the one that is constructing roads and Lusaka claims that he is the one constructing the roads. I told you Lusaka had a deal with Wetang’ula and he was to buy Wetang’ula an aeroplane. He bought it. He added that for Dismus. That for Didmus is small and for Wetang’ula is big. And while you are here suffering.”

Eseli’s Remarks Towards Wetang’ula

Eseli further told the residents that Wetang’ula should not deceive them into thinking he is involved in government decisions, asserting that the real decision-making occurs at the Cabinet table.

“Wetang’ula does not sit in Cabinet. He is Speaker. He sent Nakhumicha. Can she bang the table for us to get? Eeh.Cabinet is the table where things are shared. He is a speaker,” Eseli said according to the letter.

“When they are sitted in Cabinet do you see Wetang’ula? He only goes when taking papers for Rutto to sign Bills which oppress us. Eeh. When they are sitted on that table, to be taken there isa person who is courageous.”

Wetang’ula claims that Eseli labeled him as untrustworthy and unfit for any leadership position, describing him as a congenital con artist, a villain of the highest order, and a compulsive liar and cheat.

The Speaker also noted that Eseli accused him of being self-conceited, having dictatorial tendencies, and being an insensitive individual solely interested in personal enrichment.

Court’s Directives

In his letter, Wetang’ula has since ordered Eseli to issue an unreserved and unconditional retraction and apology, which must be published through social media and mainstream media platforms.

 Furthermore, the Speaker wants the former MP to refrain from contacting the Speaker in any manner.

In addition, Wetang’ula wants Eseli to provide an unequivocal admission of liability to facilitate the assessment of damages, which should not be less than Ksh 20 million.

“TAKE NOTICE that unless you comply with the aforesaid demands within the next FOURTEEN (14) days from the date of receipt of this demand, our most mandatory instructions are to commence legal proceedings for appropriate reliefs to our client at your own peril as to costs and other incidentals thereto,” read part of the demands.
