The Director of Public Prosecution (DPP) is set to make a decision on whether or not to charge Maxine Wahome over the death of her boyfriend, Safari Rally driver Asad Khan.
The Investigating Officer on Monday, January 30 told a Nairobi court that inquest into the rally driver’s death was complete and that the file into the probe had been forwarded to the DPP pending recommendation.
Wahome was arraigned under a miscellaneous application and has never been charged with any offence.

It was the prosecution’s application to have the miscellaneous application closed as they await directions from the DPP, a move that was objected by Asad Khan’s family lawyer Danstan Omari.
In his argument, Omari told the court the Investigating Officer has not disclosed its recommendations stating that closing the miscellaneous application without charging anyone is a set up.
“The investigations officer has not disclosed the recommendations… if the DPP decides to charge the person what happens… this is the first case where we don’t have the directions,” Omari the court.
Also present during the court proceedings was a lawyer representing the landlord of the premise where Asad Khan was staying before he met his death. The lawyer told the court that his client for access to the house, saying that he is suffering a loss of income.
“As of now we have arrears of Ksh.269,500…it’s our request that the IO gives back the premises to the landlord so that he does not continue to suffer loss of income, given the admission that the investigations are done,” the lawyer told the court.
In response, the Investigating Officer told the court that the keys to the premises will be released to the landlord once the DPP gives directions on the matter.
