Parents of different schools including Kitengela International School and Set Green Hill Academy Mixed Day, Boarding and Junior School in Kisii have sued Education Cabinet Secretary Ezekiel Machogu.
The two schools disagreed with the ministry of education over the results received demanding that the CS gives an explanation.
Represented by City Lawyer Danstan Omari, the parents contested the 2023 Kenya Certificate of Primary Education (KCPE) results.
Notably, parents from the two schools also asked that the court blocks the placement of the candidates to high schools, an activity that was set to begin on November 27.
In addition, some parents told the court that they were unsatisfied with the manner their kid’s papers were graded, claiming that the results had caused them mental stress.
“She does not understand why there is a marked variance between the marks scores by students at the school in the previous years and marks posted for the year 2023 in the same KCPE examinations as the said does not fall within a reasonable range,” the court papers read in part.

School Heads Explain Reason for the Move
According to the headteacher of Kitengela International School, the 2023 KCPE results they received did not reflect the academic abilities of their candidates.
They noted that none of the school’s 186 candidates scored 400 marks, adding that the school’s top candidate scored 358 marks, despite posting great results throughout their academic year.
Earlier on Friday, the headteacher of Kitengela International School wrote to the Kenya National Examinations Council (KNEC) to request that the KCPE results be reviewed.
In addition, the headteacher asked that all candidates’ answer scripts be thoroughly reviewed so that they are awarded their rightful marks.
“Some of our candidates have enrolled in other different schools because of the disappointment of the 2022 KCPE results and are getting their rightful marks which are higher than all their counterparts who used to perform better than them,” he wrote.

Kitengela Parents and Students Protest
Notably, the parents had earlier stormed the Kenya National Examination Council’s offices in Nairobi arguing that the results awarded to their children were inaccurate.
Also, this followed a petition by the Kenya National Union of Teachers (KNUT) to the ministry of education asking them to take responsibility for the errors recorded in the national examinations.
KNUT Kisumu Branch Secretary David Obuon wanted KNEC CEO David Njengere to respond to the various issues raised by parents.
“When results were released, there was a 3-hour delay in the SMS access of results. Are parents going to be refunded for the money used yet the results were not delivered? Who will refund them?” He posed.
Machogu Admits Record Errors in Exams
At the same time, the examination body admitted that it had recorded errors in the dissemination of the results adding that it would address the anomalies.
Further, KNEC asked aggrieved parents to lodge complaints with the examinations body after some students indicated missing marks for some subjects, while others received results for exams they never sat for.
