Albert Ojwang’s Death: DPP Charges OCS Talaam and Five Others with Murder

The Director of Public Prosecutions (DPP), Renson Ingonga, has charged Central Police Station OCS Samson Talaam and five others with murder of blogger and teacher Albert Ojwang. 

At the Kibera High Court, the DPP submitted that Samson  Talaam,  ]James Mukhwana, Peter Kimani, John Ginge Gitau, Gin Ammitou Abwao, and Brian Mwaniki Njue jointly murdered Ojwang on the night of June 7th and 8th, 2025, at Central Police Station in Nairobi.

However, the accused, who appeared before Lady Justice Diana Kavedza, denied the charges.

The DPP strongly opposed the release of the accused on bail or bond, citing several compelling reasons.

Prosecution argued that granting bail to the accused would likely lead to interference with witnesses and ongoing investigations.

DPP Charges OCS Talaam and Five Others with Murder of Albert Ojwang

It was further submitted that the accused, being serving police officers, possess significant operational knowledge, access to firearms, and influence over internal police systems, including familiarity with witnesses and records — all of which could be used to compromise the case.

Additionally, Prosecution highlighted the widespread public outrage and protests that followed the killing, noting that releasing the accused could lead to further unrest and threaten public peace and order.

The DPP urged the court to find that Prosecution had presented compelling reasons under Article 49(1)(h) of the Constitution to deny bail.

These included concerns that the accused pose a flight risk, could interfere with witnesses, represent a threat to public order and safety, and that their release would undermine the fairness and integrity of the trial.

Murder Charges Approved Against Suspects

DPP Ingonga while approving the charges on Monday, June 23, said on June 10, 2025, he directed the Independent Policing Oversight Authority (IPOA) to investigate the circumstances surrounding the death of Albert Omondi Ojwang.

Following the directive, IPOA submitted the inquiry file to the Office of the Director of Public Prosecutions (ODPP) on June 22, 2025, for perusal and legal guidance.

“Upon receipt, the DPP immediately constituted a team of senior prosecutors to undertake a comprehensive review of the file,” read the statement in part.

“Consequently, the DPP has approved murder charges against six individuals.”

“The Office of the Director of Public Prosecutions remains committed to executing its constitutional mandate in accordance with the rule of law, public interest, and administration of justice,” the statement read further.

Mukhwana’s Shocking Revelations Against DIG Lagat

This comes after PC James Mukhwana revealed the role Deputy Inspector General (DIG) of police Eliud Lagat played leading to the death of Albert Ojwang. 

Speaking in court on Monday, June 16, Mukhwana said that DIG Lagat made orders through Central Police Station OCS Samson Talaam, for Ojwang to be disciplined. 

“Ojwang’ was not supposed to be killed, it was only meant to be a disciplining. The order came from OCS Taalam, who received instructions from DIG Lagat.

“My condolences to the family of Ojwang’. May God comfort you,” said Mukhwana.

According to Constable Mukhwana, when the call came in, he was instructed to select a few suspects from cells to teach Ojwang a lesson.

Further, when he asked what would happen if things went too far, he was reassured that he was only a low-ranking officer and nothing would come back to haunt him.

Additionally, he was threatened that he would get into trouble if he failed to follow the orders. 

“There are orders from DIG Lagat, DCI officers are bringing in someone at 8:00 AM. Go to the cell and choose suspects to discipline him,” he was instructed.

Lagat had filed a formal complaint against Albert Ojwang for allegedly posting defamatory content on X, which he claimed had tarnished his reputation.

The complaint, lodged on June 4, 2025, alleged that Ojwang, using the X account “Pixel Pioneer,” made false accusations — including claims that Lagat had strategically placed trusted officers in key positions to control revenue streams and intelligence flow, and that he was under investigation by the Ethics and Anti-Corruption Commission (EACC) for purchasing a Ksh 335.9 million home in Dubai.

DIG Lagat Steps Aside

Since Lagat’s name emerged as the person behind the complaint that led to Ojwang’s arrest and subsequent death while in police custody, there has been growing public pressure for him to resign.

On Monday, June 16, 2025, Lagat released a statement announcing that he would step aside from his role to allow authorities to investigate the circumstances surrounding the untimely death of Ojwang, after he was named as a person of interest in the murder investigation.

*“In the good and conscious thought of my role and responsibilities as the Deputy Inspector General of the Kenya Police Service, and in view of the ongoing investigations into the unfortunate death of Mr. Albert Ojwang, I have today opted to step aside from the office of the Deputy Inspector General, Kenya Police Service, pending the completion of investigations.

The functions of the office will henceforth be performed by my deputy until the investigations are concluded.

I undertake to provide any support that may be required of me during the investigations. I offer my deepest condolences to the family of Mr. Albert Ojwang for their great loss,”* Lagat stated.

Ojwang died in police custody on Sunday, June 8 — less than 12 hours after arriving in Nairobi following his arrest.
