Agriculture Cabinet Secretary (CS) Mutahi Kagwe has requested comments on the draft regulatory impact statement and the Sugar Development Levy Order 2025.
In an advert on April 22, Kagwe said the Ministry of Agriculture is in the process of gazetting the draft Sugar Development Levy Order, 2025, as provided under section 40 (1) of the Sugar Act, No. 11 of 2024.
“In compliance with the provisions of the Sugar Act, the Statutory Instruments Act (No. 23 of 2013), the Ministry announces to the public the availability of the draft Sugar Development Levy Order, 2025 and draft Regulatory Impact Statement,” Kagwe said.
Kagwe said the main objective of the Draft Order is to boost and streamline the collection of levy on domestic and imported sugar.
He explained that the collected levy will be used for the development, promotion, and regulation of sugar industry for the benefit of the sugarcane growers and other stakeholders in the sugar sub-sector.
The Regulatory Impact Statement contains detailed information on the draft Sugar Development Levy Order, 2025.
“The Constitution of Kenya, 2010, and the Statutory Instruments Act, 2013 require the public to participate in the decision-making process through the submission of comments to the Ministry,” Kagwe added.
“It is in this spirit that the Ministry requests the public to participate by submitting their comments through the provided address.”
He directed all interested persons to submit written comments on the draft Sugar Development Levy Order, 2025, and the draft Regulatory Impact Statement using the prescribed public comments form.
The comments should reach the Ministry not later than fourteen days from April 22.
Sugar Development Levy Order Key Proposals
The Order introduces a 4 per cent levy on the value of domestically produced sugar, to be remitted by millers as agents of the Board.
Similarly, it proposes a 4 per cent levy on the Cost, Insurance, and Freight (CIF) value of imported sugar, to be collected directly by the Board or its authorised agents.
All levies must be remitted to the board by the 10th day of the following month after they become due.

Besides, the Ministry will hold a public forum on May 6, 2025, at 9:00 am to discuss the draft Sugar Development Levy Order, 2025, and stakeholders’ comments received, to be held at Sukari Plaza, Nairobi.
