The Transport Licensing Appeals Tribunal has issued interim orders suspending the decision by the National Transport and Safety Authority (NTSA) to revoke the operating license of Nicco Movers Limited.
The orders now allow the public service vehicle (PSV) operator to resume operations pending the hearing and determination of its appeal.
In the orders issued by the Tribunal, the PSV operator was granted temporary relief after challenging NTSA’s decision to withdraw its operating licence following safety concerns raised by NTSA. The Tribunal directed that the status quo be maintained as the appeal proceeds, effectively lifting the immediate effects of the revocation.

The orders issued by the Appeals Tribunal effectively suspend the enforcement of NTSA’s decision and restore Nicco Movers’ authority to operate while the dispute is being investigated.

The appeal was filed by Nicco Movers after NTSA revoked its operating licence over concerns relating to safety compliance and management oversight.
The development means that vehicles operating under Nicco Movers can return to the roads despite the regulator’s earlier directive prohibiting the Sacco from conducting PSV operations.
Why NTSA Suspended Nicco Movers 1 License
The transport regulator revoked the operating license of Nicco Movers 1 on June 12 following investigations linked to the death of a Kenya Medical Training College (KMTC) student, Eugene Mutuku who was allegedly thrown out of the bus.
At the time, the authority said its assessment had revealed serious deficiencies in the management and operation of the Sacco’s fleet. According to NTSA, officials responsible for overseeing the company’s operations had failed to exercise adequate control over vehicles and crew members operating under the Sacco.
How Eugene Died After Allegedly Being Thrown Out of the Bus
A final-year student at the Yatta KMTC campus, Eugene Mutuku, was allegedly thrown out of a moving Nicco bus.
Eugene was reported to have been ejected from a moving NICCO SACCO matatu on June 5 while en route to Kasarani.

Eugene was first taken to Garden City Avenue Hospital for treatment, but the facility was reportedly closed. Following this, an eyewitness called emergency services and was redirected to Neema Uhai Hospital.
Upon arrival, Neema Uhai Hospital assessed his condition as critical and immediately dispatched an ambulance, which transferred Eugene to Kenyatta National Hospital (KNH).
Paramedics from Neema Uhai Hospital reportedly worked to stabilise him during the transfer, while the eyewitness processed a payment of KSh 1,850 via the e-Citizen platform at the hospital.
However, delays were experienced at KNH due to network challenges affecting systems. Despite efforts by medics, Eugene succumbed to his injuries at KNH.
Meanwhile, the driver and conductor of the Nicco matatu allegedly fled the scene, leaving the vehicle abandoned in Kariokor and going missing following the incident.
