On January 31, 2008, David Too was shot dead by a traffic police officer in Eldoret. At the time of his murder, Too had been elected as the Ainamoi Member of Parliament (MP) on an Orange Democratic Movement (ODM) ticket following the December 2007 general elections.
His death occurred just two days after the assassination of Embakasi MP Mugabe Were, who was killed outside his residence in Woodley Estate.
According to Deputy Police Chief Gabriel Kuaya in Eldoret, David Too was killed due to a love triangle.
“We have received a report concerning one of our officers who shot a civilian as a result of a love triangle. Both the civilian who was shot dead and the officer were dating the same woman,” Kuaya stated.

However, ODM released a statement asserting that the killing was part of a plot to diminish the number of opposition members in parliament, especially since Too’s death followed closely after Mugabe Were’s assassination.

ODM leader Raila Odinga condemned the killings of Were and Too and urged for independent investigations.
“I want to say this: since the Kenyan police is a suspect in both murders, they cannot be expected to investigate themselves. Therefore, we urge the assistance of an independent organization, like the FBI, to uncover the root cause of these two deaths,” Odinga said.
The killings of Too and Occurred during a period of post-election violence in the country, further suggesting that their deaths were politically motivated.
Police Officer Sentenced to 10 Years for the Murder of Ainamoi MP and Eunice
In a 2009 judgment, the High Court in Nakuru sentenced former police officer Andrew Mueche Omwenga to 10 years in prison for the manslaughter of Ainamoi MP David Kimutai Too and a woman named Eunice. Initially charged with murder, Justice David Maraga reduced the charge, ruling that the killings took place under provocation and in self-defense.
The court established that the incident occurred on January 31, 2008, at West Indies Estate in Eldoret.
Omwenga admitted to shooting the two but claimed he acted in self-defence after being confronted and allegedly threatened by the victims, one of whom he stated he had a past romantic relationship with.

The court ruled out malicious intent, noting that the accused had not planned the attack and only realised later that Too was an MP.
However, the judge criticised the use of excessive force, as the victims were shot in critical areas such as the head, chest, and abdomen, despite not having fired any shots themselves.
Citing provocation and loss of self-control, the court convicted Omwenga of manslaughter and sentenced him to ten years in prison.
