Nairobi Senator Johnson Sakaja can now breathe a sigh of relief after the High Court in Nairobi dismissed a case against the validity of his degree.
On Tuesday, July 12, the court said that IEBC had no error in clearing Sakaja to vie for the gubernatorial seat, dismissing the complaint on the basis of lack of proof.
The High Court said that there was not enough evidence to shift the evidential burden from the petitioner to Sakaja.
The court further noted that it is the responsibility of the parties to prove the allegations they bring before it.
The petitioner, Denis Wahome moved to court seeking to temporarily bar the Independent Electoral and Boundaries Commission (IEBC) from including Sakaja on the ballot.
Wahome wanted Sakaja’s name omitted from the electoral list arguing that his degree from Uganda’s Team University is not authentic.
