The Inspector General (IG) of Police Japhet Koome and Directorate of Criminal Investigations (DCI) boss Mohammed Amin have been summoned to appear in court on Monday, November 20.
High Court Chacha Mwita directed the two to appear in court over the disappearance of Nairobi Governor Johson Sakaja’s aide Osman Ali.
Alternatively, Justice Mwita said Koome and Amin can be represented by their most senior representatives in case they will not show up themselves in court.
“I direct the IG or his most senior representative and the DCI or his senior most representative to appear in court on November 20 at 10 am and show cause why Osman should not be released from captivity in compliance with court directions issued earlier,” the justice said.
Osman’s whereabouts have remained unknown since his abduction at a mall in Nairobi on November 10, 2023.
Other Court Orders
Besides, the court directed the Attorney General and the Director of Public Prosecutions (DPP) to produce Osman in Milimani law court or any other court on Friday, November 17, 2023.
Further, the court ordered that if the two institutions do not avail Osman, then they should explain why he should not be set free.
Also, the judge ruled that Safaricom should produce car tracking records of the vehicle used by the abductors within the next 24 hours.

The directives were issued after Osman’s wife through her legal representative said the motor vehicle involved in the alleged abduction is at a police station.
Additionally, the former South C MCA and Nairobi Liaison Officer was allegedly taken by five gunmen inside a mall in Westlands at around 5 pm. They were reportedly using a double-cabin vehicle.
Additionally, this mall where the alleged abduction happened or its owners were also directed to supply the court, and Osman’s wife with the CCTV footage of November 10 covering the events surrounding Osman’s abduction and the movement of the subject motor vehicle.

DCI, IG & DPP Reluctance
According to reports, Law Society of Kenya President Eric Theuri lawyers Dancun Okatch informed the court that the directive issued that Osman should be produced in court have not been complied with.
Furthermore, the LSK President and the other lawyers told the court that the IG, DCI and DPP have not responded to affected family.
Also, the lawyers asked the investigative agencies to take the matter seriously adding that the cases of abductions are common in Kenya.
In addition, the three bodies should step up and do the investigations since it is ten days since Osman was abducted.
