The Government of Kenya has secured a major legal victory in a multi-billion-shilling international arbitration claim filed at the London Court of International Arbitration (LCIA).
The case was filed by KU Railways Holdings Limited and RVR Investments (PTY) Limited. The two companies had demanded approximately Ksh 260 billion from the Kenyan government.
According to a press statement dated 25th July 2025 by Solicitor General Shadrack J. Mose, Kenya has successfully defended the multi-billion-dollar international Arbitration Claim.
Where the Kenya dispute stemmed
The arbitration was filed in 2020 after the railway firms, previously operating as Sheltam Rail Company and Rift Valley Railways Investments, accused the Kenyan and Ugandan governments of breaching contractual agreements related to the Rift Valley Railways line, a project meant to improve regional freight and passenger transport.
“The arbitration commenced in 2020… for alleged breaches against the Interface Agreement and Railways Concession Agreement,” the statement reads in part.
“The Ksh 260 Billion Claim has been ENTIRELY DISMISSED with costs awarded in favour of the Respondents.”

The defense was led by Shadrack Mose, who was supported by senior officials from the State Law Office, including Ms. Njeri Wachira, Mr. Allan Githaiga, and several Principal State Counsels.
The Kenya Railways legal team also played a role, with contributions from Mr. Stanley Gitari and Ms. Christine Macharia.
External Legal Experts Supported the Case
Prominent legal experts also represented Kenya, including Prof. Githu Muigai SC (Lead Counsel), Ms. Wambui Muigai, Mr. Dennis Nkarichia, and Ms. Nimo B. Adan from Mohammed Muigai LLP.
Financial and technical support was provided by the firm HKA Global, while Mr. Michael Sullivan KC of One Essex Court and Prof. Albert Mumma SC also participated as legal advisors.
Victory Saves Kenya from Major Financial Burden
The Solicitor General expressed gratitude to Attorney General Dorcas A. Oduor for her support on the whole matter.

“We thank the Honourable the Attorney General… for the guidance and invaluable support provided in this matter,” added Mose.
According to the Solicitor General, this victory has saved the Republic of Kenya and, by extension, the Kenyan taxpayer from incurring what would otherwise have been a significant financial burden.
