The County Government of Narok has issued a public notice to all developers and constructors, mandating an immediate cessation of unauthorized building activities.
This decisive move aims to enforce compliance with the Physical and Land Use Planning Act, 2019, among other relevant regulations.

The notice, signed by County Secretary Ole Tuya and dated July 31, 2024, highlighted growing concerns over the rising trend of developers bypassing necessary approvals before commencing construction within Narok County.
According to the notice, unauthorized construction is a clear violation of Section 56(a) and (c) of the Physical and Land Use Planning Act, 2019.

This section grants county governments the authority to control and regulate land use and building developments within their jurisdictions to ensure proper and orderly development.
Directives Issued by Narok County to Constructors
All unauthorized building activities must cease immediately.

Developers are required to submit their building plans to the County Executive Committee Member for Lands, Housing, Physical Planning, and Urban Development within 30 days for consideration and approval.

Additionally, all building plans must be approved by the County Government of Narok, as stipulated under Section 57 of the Physical and Land Use Planning Act, 2019.
Non-compliance will result in the enforcement of sanctions detailed in Section 57(3) and (4) of the Act, which may include fines and legal actions.
Consequences failure to Comply
However, developers with ongoing unauthorized construction must submit their applications and supporting documents for compliance verification within the stipulated 30-day period.
Failure to comply will attract legal consequences as per Section 57(2), (3), and (4) of the Act.
