The CEO of the Social Health Authority (SHA) has been ordered by the Commission on Administrative Justice to release the methods and means used for testing during registration.
According to a statement dated Monday, December 8, 2025, the commission requested that the CEO facilitate JK’s information request on behalf of Africa Uncensored within 21 days.
“The Commission has ordered the Chief Executive Officer, Social Health Authority (SHA), to facilitate the request for information made by JK on behalf of Africa Uncensored contained in the dated 4th August 2025, within twenty-one days; failure to which, the Commission shall recommend criminal prosecution against the CEO in line with Section 28 of the Access to Information Act, 2016,” read part of the statement.
Additionally, the commission stated that failure to comply will result in a recommendation for criminal prosecution under Section 28 of the Access to Information Act, 2016.
Commissions Orders to the SHA CEO
The commission has ordered the Chief Executive Officer of the Social Health Authority to facilitate access to information and records related to the request made by JK on behalf of Africa Uncensored, as contained in the letter dated August 4, 2025.
According to the commission, the CEO must provide the dataset used to develop or train the model(s) currently in use.
They also directed the CEO to release the list of counties where the trained model was tested before the full rollout, along with the resulting outputs for those counties.
Additionally, the commission requested statistics for each question on the means-testing form, showing how members of the public typically responded when registering with the Social Health Authority, along with their corresponding contribution levels.
For all current, past, or updated versions of the MTI, the commission ordered the CEO to provide a list of the models used so far and the dependent variables for each model.

They further highlighted the need to release the full mathematical formulae for the MTI instrument, including, but not limited to, values such as weights or coefficients, each variable or indicator name, structural parameter values, estimation errors, and the distribution of predicted contributions per capita income, including the mean and median.
The CEO is also required to submit reports or statistical summaries of the model’s predicted outputs, including information on its current performance. This should include anonymized data collected so far, the determined Social Health Authority contributions, and the corresponding variable values provided by users or a substantial representative sample from all counties.
The commission stated that the CEO must comply with these orders within twenty-one days from the date of publication.
