Acting Attorney General Todd Blanche told Fox News host Sean Hannity that President Donald Trump would “absolutely” have gone to prison if he had not won the 2024 election.
Blanche made the remarks during an appearance on Hannity’s podcast released on Tuesday, June 2, 2026.
Hannity referenced Trump’s conviction on 34 felony charges in New York and asked whether the race amounted to “the White House or the big house.” Blanche responded: “Yes! Oh yeah, absolutely.”
Cases Cited by Blanche
Blanche pointed to multiple legal cases Trump was facing before the election, including proceedings in Washington, Florida, and New York.
“Don’t forget, he had a D.C. case breathing down his neck, he had the Florida case, which had been dismissed, but they were appealing it, and then he had a judge in New York who there’s no scenario in which he wasn’t going to send President Trump to prison,” Blanche said. “He didn’t, after the president won.”
Donald Trump was convicted on 34 felony counts of falsifying business records in New York in May 2024. He did not serve prison time following his 2024 election victory.
‘Priceless’ Consequences
Blanche described the outcome of the 2024 election as having major implications for both the country and Trump’s personal life.

“The consequences of 2024 for this country are priceless. But for him and his family, also priceless,” he said.
Blanche also addressed questions about whether the Justice Department is investigating alleged political targeting in Trump-related prosecutions.
Hannity asked whether there was a probe into grand juries and legal actions involving Trump. Blanche confirmed an investigation is underway.
“This is all being investigated, and it’s whether or not a pattern of behavior has taken place to destroy this man, one man, one family, one organization,” Blanche said. When asked if that framing was fair, he replied: “Without a doubt.”
Blanche added that investigators would need to prove a pattern of politically motivated legal actions, but said it “is not hard to do.”

Probe Into Carroll Case
The comments came about a week after reports that the Justice Department opened an investigation into whether E. Jean Carroll perjured herself in her civil sexual abuse case against Trump.
Carroll previously said in a 2022 deposition that she did not receive funding support for her lawsuit. Later, LinkedIn co-founder Reid Hoffman said he helped finance the case.
Blanche previously served as Trump’s defense attorney during the New York hush money trial before being appointed Acting Attorney General.
The interview shows ongoing claims by Trump allies that multiple criminal cases were politically motivated efforts to interfere with his 2024 presidential campaign.
