United States President Donald Trump has responded after a U.S. appeals court ruled that most tariffs imposed during his administration are unlawful.
The US Court of Appeals for the Federal Circuit rejected Trump’s argument that the tariffs were permitted under the Emergency Economic Powers Act (IEEPA), calling them “invalid as contrary to law.”
In response, Trump, in a statement on his platform, Truth Social, on Saturday, August 30, criticized the appeals court and its rulings, stating, “All tariffs are still in effect!”
He added that if these tariffs were ever removed, it would be a total disaster for the country.
Trump Hits Back After US Appeals Court Rules Most of His Global Tariffs Illegal
The US president stated that the reversal of the tariffs would weaken the nation’s financial position.
“Today, a Highly Partisan Appeals Court incorrectly said that our Tariffs should be removed, but they know the United States of America will win in the end,” he said.
“The U.S.A. will no longer tolerate enormous Trade Deficits and unfair Tariffs and Non-Tariff Trade Barriers imposed by other Countries, friend or foe, that undermine our Manufacturers, Farmers, and everyone else. At the start of this Labor Day weekend, we should all remember that tariffs are the best tool to help our Workers, and support Companies that produce great Made in America products.”
The US President added that, for many years, tariffs had been imposed on the US by what he described as uncaring and unwise politicians.
Trump added that, with the help of the United States Supreme Court, he will use them to benefit the nation and “make America rich, strong, and powerful again.”

Why the US Appeals Court Ruled Trump’s Foreign Tariff Campaign Illegal
The ruling affects Trump’s “reciprocal” tariffs, which were imposed on most countries worldwide, as well as other tariffs targeted at China, Mexico, and Canada.
The 127-page ruling stated that the IEEPA “neither mentions tariffs (or any of its synonyms) nor contains procedural safeguards that set clear limits on the President’s power to impose tariffs.”
The court ruled that the power to impose taxes and tariffs remains with Congress, and the IEEPA does not supersede this authority.

Additionally, the court noted that it is unlikely that when Congress passed the law in 1977, it intended to “depart from its past practice and grant the President unlimited authority to impose tariffs.”
“Whenever Congress intends to delegate to the President the authority to impose tariffs, it does so explicitly, either by using unequivocal terms like tariff and duty, or via an overall structure which makes clear that Congress is referring to tariffs,” the judges wrote.
The ruling comes after petitions were filed in April challenging Trump’s executive orders, which imposed a baseline 10% tariff on nearly every country in the world, as well as “reciprocal” tariffs on dozens of nations.

Today in America, we have the best congress that money can buy. In England, for example, money can only be spent on elections in the last six weeks before an election. Money should only be spent on general elections from Labor Day to Election Day. This would vastly eliminate the need for money in elections and better serve representative government.
Congress has an opportunity to curb Fascism, represent the people who do the electing, further improve real standards, and set a genuine basis on which to build for the future.
Congress, not the Executive, has plenary power over tariffs, and tariffs imposed by the president without action by Congress must be rescinded. This alone will ensure that we will not price ourselves out of the International Market, nor repeat the adversities of Smoot-Hawley, or worse, and we need not continue to suffer under Trump inspired “Robin Hood in Reverse”.
Moreover, Congress never relieved the oil companies from the Sherman Antitrust Act or the Clayton Antitrust Act, which provides for domestic competition of all corporations operating in our country, nor were oil companies relieved from rate of return regulation imposed by a government agency if competition is not met. Obviously, the domestic market must be first satisfied before oil and oil products are exported. Also, restoring oil competition in the domestic market will firmly lead to reduced farming costs, reduced transportation costs, reduced food costs, reduced housing costs, a strengthened economy, a virtual elimination of price gouging, vast improvements in the economy of struggling Americans, and reduced wasteful spending.
Also, as Trump inspired removing tax on tips will further hasten social security insolvency, we must increase the cap on social security to include high earners, resolve insolvency problems, and secure social security into perpetuity.
Also, Trump inspired removing tax on overtime induces people to work longer hours, and induces management to want them to do so, which is in opposition to any progress made by labor. Rather, amend Adamson and Fair Labor Standard Acts to reduce the workday from eight (8) hours to six (6) hours, and the workweek from 5 days to 4 days, 40 hours to 24 hours, without cutting the daily, weekly, or monthly pay, while increasing overtime from time-and-one-half to double-time to outweigh the cost of fringe benefits. Society will share in the wealth of productivity, while increasing tax revenue without raising taxes.
Also, Congress never authorized DOGE; it should be abundantly clear that the wealthy should not control democracy. We need to restore a graduated income tax that reaches above 90% to the very wealthy. Then one person, one vote, will make real sense and will not be sidetracked by money controlling our objectives. This will allow removing cuts to Medicare, Medicaid, VA, restoring the Consumer Protection Bureau, restoring proper labor agreements with the Department of Defense, undoing what has been done to the National Labor Relations Board, restoring the Chips Act, restoring the Transportation Security Agency and 47,000 TSA Officers from cancellation of their union and their collective bargaining agreement with TSA, restore the Department of Education. restore the National Laboratory Operations Bord, restore U.S. Aid overseas, provide for funds to accomplish this, and Others. Full consideration should also be given to Bernie Sanders’ proposed wealth tax. Trump’s wrecking ball imposed on America, and its people, must be reversed.
Moreover, electoral votes must cease be jumbled in states to have winner take all, as it does not comply with congressional expansion of electoral powers to citizens, further results in one party gaining votes of another party, creating battle ground states, and actions therewith to buy elections.
