Chief Justice Martha Koome has declared a total number of eleven vacancies for Court of Appeal judges.
The CJ, who is also the president of the Supreme Court declared vacant positions for eleven judges of the Court of Appeal in a February 2, 2024, Gazette notice.
“Pursuant to section 30 of the Judicial Service Act and section 3 Part II of the First Schedule, of the Judicial Service Act (No. 1 of 2011), I, Martha K. Koome, Chief Justice of the Republic of Kenya, for and on behalf of the Judiciary of Kenya, declare vacancies in the Office of Judge of the Court of Appeal of the Republic of Kenya,” reads part of the Gazette notice.
Successful applicants will work at the Court of Appeal of Kenya with specific functions including hearing appeals from the High Court.
Also, the judges will hear appeals from any other court or Tribunal as prescribed by an Act of Parliament.
The notice by CJ Koome further revealed the vacancies’ tenure of office will include retirement at the age of seventy 70 years for the judges.

Also, the retirement package includes the option for early retirement after a judge attains the age of 65 years, in accordance with Article 167(1) of the Constitution.
CJ Koome lists Constitutional and Statutory Requirements
“For appointment to the position of Judge of the Court of Appeal, the applicant must possess the listed minimum qualifications set out in Article 166 (2) (a), (b) and (c) as read with Sub Article (4) (a). (b) and (c) of the Constitution,” the notice added.
First, the applicants must be holders of law degrees from a recognized university or be an advocate of the High Court of Kenya.
Also, an applicant possessing an equivalent qualification in a Common-law jurisdiction is eligible for application.

The applicants must have at least ten years’ experience as a superior court judge.
Practitioners with at least ten years’ experience as a distinguished academic, or legal practitioner or such experience in other relevant legal field are also eligible.
Other requirements listed include having a high moral character, integrity and impartiality.
These personal requirements should be met through the requirements of Chapter Six of the Constitution on Leadership and Integrity.
In addition, the applicants should demonstrate a high degree of professional competence, communication skills, fairness, good temperament, good judgment, wide breath of both legal and life experience and demonstrable commitment to public and community service.
Salaries and how to apply
Successful applicants will enjoy a gross monthly remuneration package of between Ksh.774,845 and Ksh1,1 million.

“Based on guidelines by the Salaries and Remuneration Commission of Kenya, Gross Monthly Remuneration Package excluding benefits is Minimum of KSh. 775,845 and a Maximum of Ksh1,187,152.00,” the notice revealed.

CJ Koome further noted that the appointment shall be made in accordance with Article 166 (1) (b), (2) and (4) of the Constitution of Kenya.
The appointment is also in accordance with section 30, Part V and the First Schedule of the Judicial Service Act, 2011.
