A three-bench will on Monday, 04 July start hearing a petitioned filed by former Nairobi Governor Mike Sonko seeking orders to bar Wiper Democratic Party from replacing him in the Mombasa gubernatorial race.
In a notice issued to the parties in the case,the bench consisting of Justices Olga Sewe, Anne Onginjo, and Erastus Githinji indicated that the matter will be heard at the Mombasa Law Courts.
Last week, Chief Justice Martha Koome appointed the bench to hear and determine the matter .
“My instructions are to inform you that the honourable Chief Justice has received the original court file from the High Court in Mombasa further the CJ has empaneled a 3-judge bench to hear and determine the matter in Mombasa,” the notice read in part.
Sonko has also sued the Independence Electoral and Boundaries Commission (IEBC).
He is seeking orders to bar IEBC from printing ballot papers for the Mombasa gubernatorial race ahead of the August 9 general election until his case is heard and determined.
Sonko was locked out of the race after IEBC failed to clear him after he represented his degree certificate after the clearance deadline.
He had instead presented a letter certified by his lawyers showing that he indeed held a degree from a local university.
WIPER party had planned on presenting another candidate following Sonko’s disqualification
His case before the IEBC disputes tribunal challenging his disqualification was dismissed.
