A businessman has sued Absa bank Kenya for leaking his confidential information to third parties.
He claims leaking of the information was without his consent.
The suit is before the Mombasa Commercial Bank Admiralty court.
Kirui Kamwibua is seeking damages of Ksh19 million as a loss of income.
He also wants the bank to pay Ksh1.2 million for loss of goodwill and Ksh9.2 million for the loss of fixed assets.
Kirui is the owner of New mega Africa Ltd listed as the plaintiff.
He blames a bank employee for leaking the data.

The plaintiff says his business operations have been negatively affected.
“As a result of the leakage, the plaintiff’s creditors and other suppliers descended upon him and interrupted the business operations,” he said.
His lawyer further argues failure to maintain the secrecy of his accounts infringed on his right to privacy.
He states that the move amounts to a breach of its common law of fiduciary duty.
Further,he argues that efforts to save his transport business by requesting the bank to restructure its loan obligations failed .
This he says resulted in financial sabotage.
“The defendant’s employees were demanding kickbacks and other incentives prior to approving or disbursing loans and failure to take action upon lodging complaints of leakage of confidential information,” he notes.
