The Director of Public Prosecutions (DPP) has officially withdrawn all charges against former Mungiki leader Maina Njenga.
The announcement was made by Njenga’s lawyer Ndegwa Njiru on Monday, November 11. Njeru has celebrated the decision of the DPP, highlighting it as a victory for his client.
The decision has marked an end to the high-profile case that had attracted national attention.
“DPP withdraws Maina Njenga’s case. Freedom is here,” stated Njiru.
Njenga, and 10 co-accused, faced seven charges, including membership in an outlawed criminal group, Mungiki, and engaging in organized crime activities in Bahati, Nakuru County.

DPP Case Againts Maina Njenga
The alleged incidents reportedly occurred between May 11 and May 18, 2023. Mungiki, once known for its involvement in organized crime and political violence, was outlawed by the Kenyan government in the early 2000s, making any affiliation with the group a criminal offence.
The case opened dramatically in November 2023, when the first witness for the prosecution, Njenga’s mother-in-law, collapsed while taking her oath to testify.
Moreover, the charges against the former Mungiki leader drew from evidence following a raid at Njenga’s home on May 12, 2023, by the Directorate of Criminal Investigations (DCI).
While testifying in court, one of the DCI officers Athumani Asmani said that about 20 officers from Nakuru West Sub County, Nakuru East, Lanet and Bahati assembled at Lanet Police station at about 4 am.

Further, they left the police station and proceeded to Njenga’s house where uniformed officers proceeded to the gate. The caretaker resisted but after 15 minutes, he opened the gate.
However, the former Mungiki leader was not home during the raid.

Items Recovered from the Raid
Another detective testified that a toy pistol, Tokarev pistol, ammunition and bhang were allegedly found in Njenga’s house.
Further, he said that they found the Tokarev pistol covered with a white cap in one of the wardrobes of the master bedroom.
Also, the police recovered three blunt ammunition inside a magazine.
However, during cross-examination, the officer said that Njenga could not be said to be in possession of the firearm and ammunition because he was not at the scene.
