In Kenya, filing nil returns does not automatically protect taxpayers from scrutiny. Under the law, the Kenya Revenue Authority (KRA) can monitor bank and mobile money inflows and classify unexplained deposits as taxable income if the source of the funds is not verifiable.
The authority operates under Section 3 of the Income Tax Act, which empowers it to presume that any unexplained funds constitute income.
This burden of proof lies with the taxpayer, who must provide credible documentation to show that deposits are non-taxable, such as loans, gifts, refunds, or money held on behalf of others.
How KRA Taxes Funds Despite Nil Income Returns
Tax and financial management trainer CPA Wachira Joseph noted that Tax Appeals Tribunal rulings reinforce this approach, confirming that KRA can lawfully recover taxes even when nil returns have been filed.
In his explanation, Wachira confirmed that if money flows into your bank accounts and you cannot explain the source, KRA may treat all deposits as income, and filing nil returns does not automatically protect you from this.
KRA will simply decide to treat any unexplained deposits as taxable income and assess tax, including penalties and interest, on those funds.
“KRA will simply decide: – All deposits = income. – And tax those deposits,” Wachira noted.
He further advised that to safeguard against unexpected tax liabilities, maintain contracts, loan agreements, and reconciliations, properly document funds held for others, and engage a tax adviser to ensure records are defensible.
When Are Nil Returns Allowed to be Filed
According to the Kenya Revenue Authority, taxpayers can file nil returns if they have no taxable income during the year but still hold an active KRA PIN with an income tax obligation.
This commonly applies to students, unemployed individuals, or PIN holders with no employment, business, or rental income.

Nil returns are also permitted for dormant businesses that recorded no turnover during the reporting period.
Even without financial activity, the authority requires PIN holders to file returns annually to remain compliant.
The authority indicated that nil return filing was temporarily suspended until May 1, 2026 for data validation.
During this period, KRA systems cross-check taxpayer information with banking records, Safaricom data, and eTIMS transactions.
The filing window will run from May 1 to June 30, 2026, for the 2025 income year, with a minimum penalty of KSh 2,000 for late submission.

Risks of Filing Nil Returns with Financial Activity
The Revenue Authority warns that filing nil returns while receiving income can trigger audits. Data mismatches between declared income and bank or mobile money records may lead to tax investigations.
Recent rulings by the Tax Appeals Tribunal have reinforced that unexplained deposits can be treated as taxable income.
This means taxpayers who file nil returns but have undocumented inflows risk tax assessments, penalties, and interest.
