A 54-year-old man from Homabay county was on Friday, February 9, 2024, sentenced to life imprisonment for defiling his 11-year-old child contrary to Section 20(1) of the Sexual Offences.
Ndhiwa Law Courts Resident Magistrate passed the sentence to a 54-year-old man for defiling his own 11-year-old child in August 2020.
During the announcement of the verdict, the magistrate stated that the evidence produced was satisfactory.
The accused, Samuel Odie, reportedly committed the offence at Luanda village within Ndhiwa Sub county-Homabay County.

The Prosecution side led by Moses Okerosi lined up 6 witnesses whose testimonies corroborated in proving the case beyond reasonable doubt.
Another man jailed for defilement
On January 31, a 45-year-old father from Kwale was found guilty of defiling his 13-year-old daughter in violation of Section 20(1) of the Sexual Offences Act No. 3 of 2006.
He was also handed a life sentence for the offense.
Additionally, in violation of Section 11(A) of the Sexual Offenses Act No. 3 of 2006, the man was found guilty of an indecent act.
In a statement on Thursday, February 1, the Office of the Director of Public Prosecution (ODPP) noted that the accused committed the act on different dates between January 2019 and March 2023 at Nyacha village in Taru, Kwale County.
Prosecution Counsel Annette Wanjohi presented five witnesses including the minor before the Mariakani Senior Resident court during the trial.
After taking consideration of the witnesses’ testimony and evidence provided, the court established the prosecution’s case was beyond doubt.

The ODPP said that magistrate Olivia Koranje rejected the accused’s unfounded claim that he was set up by his wife.
The senior magistrate went on to say that the medical findings supported the witnesses’ accounts.
“Mariakani Senior Resident Magistrate Hon. Olivia Koranje dismissed the accused’s defense that he was framed by his wife as baseless, since the medical report concurred with the testimonies of witnesses,” a statement by the ODPP read in part.
