Circumstances Under Which Companies Are Placed Under Receivership
Receivership is a legal process that allows lenders to recover money when a company fails to make loan payments. A receiver may also be appointed during a shareholder dispute to complete a project, sell assets, or dispose of the business.

Common circumstances leading to receivership include:
- When a company fails to meet its payment obligations, a secured creditor (such as a bank) can appoint a receiver to take control of collateralized assets and sell them to recover the outstanding debt.
- A company may be placed under receivership if its liabilities exceed its assets and it cannot meet debt obligations as they fall due.
- A court may appoint a receiver if there is a risk that a company’s assets could be wasted, hidden, or mismanaged, ensuring they are preserved for the benefit of creditors.
