In a pre-sentencing report, dated March 6, 2024, the prosecution submitted before the High Court on behalf of Monica Kimani’s family, that Joseph Irungu alias Jowie be sentenced to death.
Justice Grace Nzioka on Wednesday, March 13, indicated that the family argued that there were aggravating factors in the matter that had to be considered.

Further, Nzioka said that the prosecution asked the court to note that Monica Nyawera Kimani’s lifeless body was found inside a bathtub with her throat brutally slit and hands tied.
Additionally, they argued that deceased died due to severe neck injuries due to a sharp force.

“The September 20, 2018, the deceased Monica Nyawera Kimani lifeless body was found inside a bathtub with her throat brutally slit and hands tied.
“The postmortem report produced by Doctor Peter Ndegwa confirmed that the deceased died due to severe neck injuries due to a sharp force,” the judge read.

Other Reasons for the Death Sentence
At the same time, the prosecution highlighted that that there was serious and grievous harm to the deceased.
In addition, they noted that the weapon used was a dangerous and that the offence was an intricate planning.
“In capital letters, the court has been invited to note that there was no degree of provocation from the deceased towards the offender.
“After commission of the offence, there was an attempt to conceal the evidence. The crime had serious physiological and physical harm to the victim and the family,” added the judge.
Based on this, the prosecution invited the court to pronounce a death sentence.

The Family of Monica Kimani Highlights how they Were Affected
Subsequently, the family of the deceased said that the death occasioned them monumental psychological impact and they are still to cope with the death.
“The mother of the victim broke down severally and wailed and her interviews had to be stopped to allow her to calm down.
“She wondered why anyone would kill her only daughter who was bold and her friend. According to her, the only appropriate sentence is death,” said the Justice.
Also, the judge said that the father of Monica revealed that the extensive media coverage impeded the family’s emotional healing.
On the other hand, it was revealed that Monica’s younger brother stopped watching news and stopped trusting people among other social activities including working in an office.
“The younger brother stopped watching news, stopped trusting people, only does online jobs, limits his movements and stopped going to public places,” read Nzioka.
The court was also told that the business which Monica was running collapsed, and the family became drained financially and they were not able to meet their day-to-day needs.
“The family of the deceased were of the view that the maximum sentence provided should be pronounced, and the sentence will not console them or erase their pain,” she noted.
