Former president of the Law Society of Kenya (LSK) Nelson Havi stated that police officers who have confessed to having framed innocent Kenyans must be punished.
Havi’s comments came after the recent withdrawal of high-profile cases by the Directorate of Public Prosecutions, Noordin Haji.
Moreover, as per the withdrawals, the officers claim that they received instructions from senior officials. However, Havi noted that the officers should be charged on an individual basis on grounds of malicious prosecution.
“All these police officers publicly confessing that they received “instructions from above” to frame innocent people in the cases being withdrawn should be held accountable. Claims of malicious prosecution ought to be mounted against them personally for deterrence.” Havi tweeted
Nevertheless, the move by DPP Haji to withdraw the cases caused a stir among many quarters in the country including the Law Society of Kenya, which came out to question the many withdrawals.
Led by LSK president Eric Theuri, the law society said the DPP owed Kenyans an explanation on the discontinuation of corruption cases.

In addition, the cases that the DPP withdrew include CS nominees Aisha Jumwa’s Sh19 million graft case and Mithika Linturi’s alleged rape case which was going to be settled out of court.
Fuuthermore, the DPP also withdrew charges against former Kenya Power MD Ben Chumo and ten others in a Sh400 million graft case.
The former Kenya Powe MD had been charged in 2018 alongside Muwa Company Limited for deliberate failure to comply with procurement procedures in the purchase of transformers.
Nonetheless, the DPP is currently reviewing deputy President Rigathi Gachagua’s Sh7.3 billion graft case and that of businesswoman Mary Wambui of an alleged tax evasion case of Sh2.2 billion.
