David Oyando, popularly known as Mulamwah has filed a lawsuit against his ex-partner, Caroline Muthoni accusing her of defamation and child abuse.
The comedian, represented by MNO Advocates LLP, alleges that since the birth of their child over a year ago, his baby mama has obstructed his access to their child and made defamatory statements against him.
“Since the birth of the minor, over a year ago, you have made it difficult and almost impossible for our client to enjoy a working relationship with the minor, therefore damaging the minor’s right to enjoy fatherly love and responsibility,” the court papers read in part.
According to Mulamwah’s legal team, Muthoni has been making it difficult for him to have a relationship with their child, demanding unreasonable conditions and shifting demands.
The content creator also claims that Muthoni has commercialized their child’s image without consideration of the child’s well-being or his consent as the child’s father.
“You have been commercializing the minor’s image for your own good with little concern for the minor’s wellbeing and our client’s right to grant consent,” the statement continued.
The crux of the matter revolves around allegations made by Muthoni against the comedian, in a YouTube video titled “ASK ME ANYTHING RESPONSE…UWEH,” broadcasted on November 29, 2023.

In the video, Muthoni labeled Mulamwah as a “deadbeat father” further accusing him of neglecting his parental responsibilities.
She noted that the baby daddy had refused to share the costs of raising their child, despite his earlier revelation that he has sent her money for upkeep via MPESA on several occasions, but she reportedly reversed without explanation.
Additionally, the baby mama admitted to resolving Mulamwah’s name from the child’s birth certificate and renaming the child without her father’s consent.
The comedian’s legal representatives argue that Muthoni’s statements are not only false but are also damaging to his personal and professional reputation.
As such, Mulamwah noted that Muthoni’s actions have subjected him to online bullying, ridicule, and threats, tarnishing his image as a public figure.
Mulamwah as a Public Figure
Furthermore, he noted in the court papers that the ex-girlfriend is exploiting their breakup for her online career and commercializing their child’s image at his expense.
“Your accusations are not only untrue but also detrimental to our client’s personal and professional reputation as he is a public figure.
“Your defamatory statements have caused significant harm to our client’s reputation among right-thinking members of society. The consequences of your actions have been exposing our client to online bullying, ridicule and threats of personal harm,” read the statement.
In response to these allegations, Mulamwa demands that Muthoni publicly retract her defamatory statements and issue a public apology of equal prominence.
He also insists on the removal of all images and videos of their child from Muthoni’s YouTube channel.
Also, the comedian noted that he will cater for their child’s school needs including fees once the child hits three years old.

He will also be sending monthly stipend for the minor’s upkeep upon agreement.
Additionally, the comedian has asked for clarification on the alteration of their child’s name without his consent and requests a copy of the current birth certificate in which he claims to use it in registering his child’s medical cover and also to get her a travel passport.
Mulamwah’s legal team emphasizes his willingness to engage with Muthoni concerning their child’s welfare, highlighting the importance of parental responsibility irrespective of marital status.
As such, they proposed an amicable arrangement for the child’s welfare, away from online disputes, and suggested a virtual meeting to draft a Parental Responsibility Agreement.
In the document, Mulamwah’s lawyers noted that failure to comply with these demands within ten days could result in legal action, including defamation and child abuse charges, along with associated costs.
The two welcomed their daughter on September 20, 2021, and the comedian recently admitted he doesn’t see his daughter more often.
He also claimed that the ex-girlfriend threatened to change their daughter’s name after a fan asked him how often he sees his daughter.
The comedian is currently expecting a baby with his new girlfriend Ruth, months after breaking up with his baby mama Carol Sonie.
