Elvis Opiyo, the man accused of masterminding the acid attack on SDA gospel singer Mary Claire Ochieng, died at his home in Nairobi’s Umoja estate, bringing a dramatic turn to a case that has attracted national attention.
Opiyo died on Tuesday, August 11, while out on bail, nearly five months after Mary Claire was attacked with acid along Ngong Road in Nairobi on March 17.
His death comes before the conclusion of court proceedings linked to the case.
The case sparked outrage across the country after the singer sustained severe burns and serious eye injuries in the attack, leaving her facing a long and difficult recovery journey.
According to investigators, Mary Claire was attacked by an assailant who allegedly acted on behalf of people known to her.
Detectives later arrested Opiyo and other suspects as they sought to unravel the circumstances surrounding the incident.
Elvis Opiyo’s Case That Shocked the Nation
On March 22, detectives arrested Opiyo before presenting him before the Kibera Law Courts.
Prosecutors linked him to the attack and sought more time to complete investigations into allegations that he had played a role in planning the assault.

Court proceedings also revealed claims that Mary Claire had previously reported incidents involving Opiyo before the acid attack.
Investigators relied on witness statements, phone records and other evidence as they pursued the case.
Throughout the proceedings, Opiyo denied the accusations against him. The matter remained before the courts at the time of his death.
The singer’s injuries attracted sympathy from Kenyans at home and abroad, with well-wishers contributing towards her treatment and recovery.
The attack left her with life-altering injuries and reignited debate over violence against women and the protection of victims.
News of Opiyo’s death spread quickly on Tuesday, prompting mixed reactions online.
Christian ministry group Lamb’s Ministers mourned him in a condolence message, describing him as a fellow minister, brother in Christ and co-laborer in the work of the Lord.
The group extended its sympathies to Lighthouse Ministries, his family and friends.
“We mourn with you in this difficult time. Elvis was not only a fellow minister, but a brother in Christ and a co-labourer in the work of the Lord,” the ministry said.
While some expressed sympathy for his family, others reflected on the suffering endured by Mary Claire and the unanswered questions surrounding the attack.
What Happens to the Case Now?
Under Kenyan law, criminal proceedings against an accused person come to an end when that person dies before the case is concluded.

This means the criminal case against Elvis Opiyo will abate, as criminal liability is personal and cannot be transferred to family members or the deceased person’s estate.
As a result, the court cannot make a finding on whether Opiyo was guilty or not guilty of the allegations.
Once his death is formally communicated to the court and confirmed through the necessary documents, the proceedings against him will effectively be closed.
However, his death does not automatically end all legal action arising from the case.
Authorities can still investigate and prosecute any other individuals found to have participated in or facilitated the attack.
Any accomplices, recruiters, financiers or attackers linked to the incident may still face criminal charges if sufficient evidence exists.
In addition, Mary Claire Ochieng may still pursue civil proceedings seeking compensation for medical expenses, pain and suffering, loss of income and other damages.
Unlike criminal cases, civil claims can continue against a deceased person’s estate through legally appointed administrators.
Police may also continue investigating the circumstances surrounding Opiyo’s death.
If questions arise over the cause or manner of death, a magistrate can order an inquest to establish exactly what happened.
