A Nairobi Court on Wednesday, October 11 acquitted former water and sanitation Principal Secretary – PS Julius Korir after he was dragged to court over wife beating.
In her ruling, Milimani law Court Magistrate Dolphina Ogola noted that the prosecution had failed to prove beyond reasonable doubt that Korir indeed assaulted his wife, Evelyn Koech in 2020.
The court further acknowledged that the complainant did not allow the law enforcers to do their work, adding that the prosecution witnesses did not seem independent.
Furthermore, the court ruled that the investigating officers seemed to be acting on instructions from Evelyn instead of acting independently.

In addition, the complainant was faulted for not producing proper evidence of the alleged assault.
“The investigating officer seemingly was acting on instructions of the victim and could not do an independent job,” the Magistrate said.
She added, “The complainant did not produce a P3 form in court indicating injuries inflicted on her.”
The court further termed the prosecution witness as the complainant’s house help and clueless with the case when asked to name other coworkers at the house.
“In view of the foregoing, this court finds that prosecution has not proved their case as to the threshold and this court finds that the accused herein be discharged under Section 215 of the CPC unless otherwise held in law,” the magistrate ruled.
Similarly, Korir had in July 2023 defended himself in court further pleading with the court for acquittal over lack of evidence.
Korir said the allegations were not true and that the charges against him were of settling a score or personal vendetta against him.
