The Independent Electoral and Boundaries Commission (IEBC) on July 25, announced the reallocation of ten seats, one in the National Assembly and nine in various County Assemblies.
This follows the declaration of vacancies due to the resignation or death of previous occupants.
In a special gazette issue published on July 24, 2025 (Notice No. 10083, Vol. CXXVII–159), the IEBC confirmed the replacement of nominated members based on the party lists submitted during the 2022 General Election.
“The Commission has reallocated one (1) special seat in the National Assembly and nine (9) special seats in various County Assemblies,” read the Gazette notice signed by IEBC Chairperson Erastus Eung Ethekon.
Among the key changes is the removal of John Mbadi Ngongo, who had been nominated by the Orange Democratic Movement (ODM) to represent the workers’ category in the National Assembly. He left his seat in Parliament after his appointment as a Cabinet Secretary during the formation of the broad-based government in 2024.

IEBC addresses the reallocation
The Commission said the reallocation was done per Article 90 of the Constitution and Section 37 of the Elections Act, which governs the nomination and reallocation of special seats through proportional representation based on party lists.
The county-level reallocations involve members nominated to represent special interest groups, including youth, women, and persons with disabilities, under various political parties.
The changes were effected after the respective Speakers declared the seats vacant.
IEBC stated that the nominations were filled based on the order of priority in the party lists provided during the last general election.
Political parties retain their representation
This ensured that political parties retain their proportional representation in legislative bodies.
“The Commission is mandated to conduct elections based on proportional representation through the use of party lists,” the IEBC noted.
Additionally, the Commission noted that such measures uphold democratic values and constitutional requirements.

The electoral body reiterated its commitment to managing the electoral process with fairness, inclusivity, and transparency, particularly in representing marginalised groups.
“By ensuring that party list allocations are conducted in strict adherence to the law, the Commission continues to promote equitable representation and safeguard the integrity of our democratic institutions,” IEBC stated.
The announcement came at a time the Electoral Commission was preparing to hold by-elections to fill vacant seats in the Senate, National Assembly, and County Assemblies. Filling the seats had been delayed due to the prolonged wait for reconstitution of the IEBC after its seven commissioners exited shortly after the 2022 elections.
Speaking after assuming office as the IEBC head, Chairman Erastus Ethekon Edung assured that the Commission would move with speed to fill the seats left vacant in the duration between the 2022 elections and the reconstitution of the body.
In total, the Commission is preparing to conduct 23 by-elections including for one for a Senator (Baringo), six for Members of the National Assembly, and 16 for Members of County Assembly.
