The Political Parties Disputes Tribunal has extended orders stopping the Orange Democratic Movement (ODM) from expelling Kisumu Senator Prof Tom Ojienda and lawmakers Phelix Odiwuor alias Jalang’o and Elisha Odhiambo from the party.
The tribunal has directed that the matter be mentioned on October 3rd for further directions.
Further, PPDT directed the orange party to file their responses to the application within 5 days of the date of service.
“In the interim and pending the hearing and determination of this Application, this Honorable Tribunal hereby issues interim conservatory orders staying the implementation and/or execution of the decision of the 1st Respondent to expel the Complainant/Applicants, from the Orange Democratic Movement Party,” PPDT chairperson Desma Nungo said in court papers.
The party kicked out Jalang’o, Gem MP Elisha Ochieng’ Odhiambo, Suba South’s Caroli Omondi, Gideon Ochanda of Bondo, and Senator Ojienda.

According to the Raila Odinga-led party, the legislators betrayed the party that took them to Parliament by agreeing to work with President William Ruto.
However, Jalang’o and Senator Ojienda went ahead and obtained the restricting orders.
ODM Disciplinary Committee
The MPs are facing allegations of violating the party constitution and section 14A of the political parties Act 2011.
ODM accused them of openly associating with and supporting activities of a rival political party and opposed lawful decisions made by the party.

“The party is hereby directed to commence the process of removing them from the register of the party,” read the statement from ODM.
However, the MPs argued that on September 6, 2023, to their surprise, not having been heard on the subject charges, ODM party announced their expulsion.
The lawmakers further argue that the decision to expel them from the party was premature.
Days after the expulsion, the leaders met President William Ruto at State House where they pledged to continue supporting him.
Ojienda and Jalang’o have vowed to stay put, saying they will defend their seats on ODM.
