The Universities Fund (UF) has issued an update on the New Funding Model for University students after the court blocked government from proceeding with its implementation.
In a notice to stakeholders on Thursday, October 17, UF said it is aware of the issues raised by High Court Justice Chacha Mwita who made the ruling.
The Fund said the ruling might create unpredictability for university students but pledged that it is engaging the Ministry of Education to provide a solution.
“We recognize concerns surrounding the court order issued by Justice E.C Mwita on October 3, 2024, regarding the implementation of the New Funding Model for University students,” the statement reads in part.
“We understand this situation may create uncertainty and we want to reassure you that we are actively working with the Ministry of Education to explore all legal avenues for an amicable and constructive resolution.”
UF said it remains committed to providing scholarships to university students.
Additionally, the Fund said it believes in open communication and is committed to finding solutions that prioritize the needs of students.
This would in turn ensure the students continue their education without disruption.
“Thank you for your understanding during this time,” UF said.
Court Ruling on New Funding Model
Justice Mwita suspended the implementation of the new university funding model until a case filed by four petitioners is heard and determined.
The implementation has been halted until the case is heard and determined with the next hearing set for December 16, 2024.
Kenya Human Rights Commission (KHRC), the Elimu Bora Working Group, Boaz Waruku, and the Students Caucus filed the case on October 13, 2023.

The petitioners argue that the funding model is discriminatory and locks thousands of students out of higher education.
Mwita also mentioned that the case faced delays after the Attorney-General, Education CS, and the Kenya Universities and College Placement Service failed to file their submissions on time.

Questions Raised Regarding the Model
The model, launched on May 3, 2023, by President William Ruto is meant to mainstream equity in financing university and TVET students through a combination of scholarships and loans.
In September, the Ministry of Education unveiled a national committee comprising 129 members to review the new model following complaints raised by several stakeholders.
The model sparked outcry since its inception, with sections of Kenyans questioning its practicality.
In particular, concerns were raised over the Means Testing Instrument (MTI) used for placing students under different fee bands.
