Detectives from the Directorate of Criminal Investigations have revealed why the former Kiambu County Governor Ferdinand Waititu was arrested after a forensic analysis.
Following an in-depth analysis of his video that was circulated in social media, it was established that the former governor’s remarks indeed constituted offensive conduct.
This was plain after a thorough examination of the footage, which captured Waititu speaking in Kikuyu, a vernacular language.
Waititu was arrested on September 30, 2024, and was put behind bars as he awaited arraignment for offensive conduct, in violation of Section 94(1) of the Penal Code.
“His arrest came in response to a report by a concerned citizen, who confided through the DCI’s toll-free number 0800 722 203,” the DCI statement read in part.
The report drew attention to a video that circulated on social media, in which Waititu, speaking at a public rally in Ruiru Stadium, allegedly made inflammatory and abusive remarks likely to provoke a breach of peace.
Moreover, the video is believed to have been recorded on September 29, 2024, and was posted on TikTok by Kikuyu Nation TV.
Upon receiving the tip, DCI’s Cyber Crime Unit was immediately deployed to investigate the matter.

Raw Footage
In collaboration with Communications Authority of Kenya (CA), Investigators retrieved the raw footage from its publisher, @kikuyunationtv.
Further, the footage was certified and a comprehensive translation of the speech from Kikuyu to English was later conducted by an expert to ensure accuracy.
The evidence was firmly established, and the investigative team recommended that Waititu be formally charged under Section 94(1) of the Penal Code for his offensive conduct.
The DCI extended its gratitude to vigilant citizens for sharing vital intelligence, which strengthens efforts to safeguard national peace and stability.
Furthermore, the DCI emphasized that collaboration fosters greater trust between the public and law enforcement. In addition, it reinforces a shared commitment to a secure and harmonious society.

Waititu Former Cases
Former Governor Waititu has, in the past, found himself on the wrong side of the law. He was previously charged with corruption, conflict of interest, and abuse of office.
The corruption charges were brought against Waititu, his wife, and a contractor, involving a Ksh 588 million graft.
Additionally, another accusation against him involved acquiring an indirect private interest of Ksh 25.6 million through contracts awarded to a company linked to him.
