A court has directed the Director of Criminal Investigations (DCI) George Kinoti to produce the original will of the late Tob Cohen.
The will is at the centre of an inheritance battle before a succession court.
Cohen’s widow Sarah Wairimu is battling for the control of her late husband’s estate with her sister Gabrielle Hannah van Straten.
Trial Judge Mugure Thande issued the Summons following an application by the Cohen family lawyer Danstan Omari
Omari wants the original will tabled in court so as to allow Cohen’s sister Gabrielle Hannah van Straten to compare the will left behind and the one presented by his widow Sarah Wairimu Kimotho.
During a cross examination, Hannah told the court during that Wairimu was assisted by her defense lawyer Philip Murgor to forge a will that she presented in court.
Hannah says that she reported the matter to the police and Murgor was supposed to be arrested and charged but the Director of Public Prosecutions Noordin Haji declined to give consent.
At one time, Hannah had filed a petition seeking the removal of the DPP from office over what she termed as interference with the Cohen case.
She argues that only the original will assist the court to make an informed decision.
Hannah and Sarah are engaged in a vicious court battle on who should control the estate left behind by Cohen.
Both are laying claims on the inheritance with the Cohen family claiming that Sarah was not mentioned in the original will.
Sarah on the other side is insisting that Hannah does not have any legal right to claim inheritance from his late brother.
Cohen, an Israel national was found murdered and his body dumped in a septic tank in his compound three years ago.
His wife Sarah Wairimu Kimotho and Peter Karanja have since been charged with murder.
