Doctor Repeatedly Rapes Dialysis Patient During Treatment

A doctor at Pandya Memorial Hospital is facing allegations of sexual assault after reportedly raping a female dialysis patient during her treatment sessions.

The abuse occurred over several months, starting in late 2024 and continuing into 2025, according to a statement from the Federation of Women Lawyers in Kenya (FIDA-Kenya).

The survivor, a woman undergoing regular dialysis, said that the doctor took advantage of her vulnerable position during early morning treatment sessions. 

Moreover, she reported that the doctor harassed her with inappropriate comments, groped her, and ultimately raped her during the treatment, despite her attempts to report his actions to hospital management.

The hospital has not denied the survivor’s statement.

“The inhuman acts happened from late 2024 to this year. This egregious act violates medical ethics, criminal law, and the fundamental rights of patients to safety and dignity.”

“FIDA-Kenya is disturbed that senior Pandya Memorial Hospital staff repeatedly ignored the survivor’s reports of the doctor’s conduct,” stated FIDA.

FIDA Takes Action Against the Doctor

FIDA-Kenya has strongly condemned the doctor’s actions, describing the assault as a clear violation of medical ethics, criminal law, and the patient’s fundamental rights.

Additionally, the organization has criticized the hospital’s management for failing to act on the survivor’s complaints, allowing the abuse to continue unchecked.

“This crime not only violates the survivor’s safety and dignity but also represents a systemic failure by the hospital to protect its patients. The actions of the doctor and the inaction of hospital staff have endangered the life and well-being of a vulnerable patient,” FIDA-Kenya stated. 

In response to the assault, FIDA-Kenya has called for immediate legal action.

The organization has urged the Directorate of Criminal Investigations (DCI) and the Office of the Director of Public Prosecutions (ODPP) to arrest and charge the doctor.

Further, they have also demanded that the specific staff members who ignored the survivor’s reports be investigated and held accountable.

Penalties the Assailant is Facing

The sexual assault of a dialysis patient while undergoing the actual dialysis process warrants the maximum penalty under the following laws:

Section 3 of the Sexual Offences Act of 2006 on rape carries a minimum sentence of ten years, extendable to life imprisonment and Cap 63, the Penal Code which allows the hospital management to be charged with neglect of duty and complicity in the crime.

Also, The Health Act of 2017 and Cap. 253, the Medical Practitioners and Dentists Act which allows regulatory action and revocation of licenses of health facilities that fail to ensure patient safety.

Cap. 257, the Nurses Act which provides disciplinary measures against the nurses for professional misconduct.

In addition to the demands issued, FIDA-Kenya will file a civil lawsuit against Pandya Memorial Hospital Mombasa and seek compensation for the survivor for gross negligence and failure to protect her.

“Within the next five days, FIDA-Kenya will write to the Health Department in Mombasa, KMPDC, NCK, and the Ministry of Health with specific practice and policy demands to proactively protect all patients from different forms of abuse.”
